Colleen Jarrott to Present on International Liability Issues for Transnational Carbon Capture and Storage (CCS) Projects at the ABA's Houston Energy Conference
New Orleans-based partner Colleen Jarrott will present at the American Bar Association's (ABA) Energy Conference in Houston, Texas, on February 29, 2024. With Hinshaw also serving as a conference sponsor, Jarrott will present in a CLE session titled "Carbon Capture and Storage (CCS): International Liability Considerations Resulting from Transnational Projects." Carbon capture and storage (CCS) mechanisms are being implemented in many countries, including Latin America. Brazil's PreSalt Province is an example of this trend. Other countries in the region are developing their own systems and comparing regulatory approaches. International liability in transnational deals is a crucial aspect of a CCS legal regime.
The session will address the following:
(1) The regulatory development of CCS projects in the Latam Region
(2) A comparison of regulatory and operational perspectives between the Latam Region and Louisiana and Texas in the U.S.
(3) How to mitigate international liability using global mechanisms and legal constructs that have proven to be reasonably effective, such as the International Oil Pollution Compensation Funds (IOPC Funds) in the maritime context, among others
(4) Strategies to reduce risk and liability in cross-border transactions between the U.S. and other countries
