Cassidy Chivers Quoted in Bloomberg BNA Article on Anti-SLAPP Law Coverage
Cassidy E. Chivers, a San Francisco-based partner at Hinshaw & Culberson LLP and member of the Lawyers for the Profession® group, was quoted in the article, "Anti-SLAPP Law Covers Concealment In Negotiations to Settle Litigation," published by the Bloomberg BNA Lawyers' Manual on Professional Conduct, Vol. 32 No. 19 on September 21, 2016.
The article discusses the holding by the California Court of Appeal, Second District that a company's alleged concealment of a key document during negotiations to settle a suit qualifies as protected activity for purposes of applying California's Anti-SLAPP law in an action to rescind the settlement. Ms. Chivers comments on how the case shows that an anti-SLAPP motion can be an important tool to combat an action alleging discovery abuse in a prior litigation. "Courts typically don’t want a roundelay of litigation where one case spawns a second or even a third case complaining about conduct in the first suit," she explains.
