Kristen Perkins Discusses with CBS News the "Flood" of Lawsuits Alleging ADA Violations by Business Websites
Hinshaw partner Kristen Perkins was featured in a CBS News article titled "A flood of lawsuits demand websites accommodate the disabled." The article discusses a flood of federal class actions filed against companies that allege "their websites don't comply with the Americans With Disabilities Act (ADA) because people with physical challenges have difficulties using them."
"While retail establishments have had the most filings," Perkins said, "those in the health care industry, restaurant and nonprofit sectors, in addition to others, have had to defend these lawsuits." She suggests that owners of websites would benefit from a "pre-suit requirement" currently being considered in a bill before the U.S. House of Representatives, which would give companies six months to fix ADA-related problems before they can be sued.
