Bessie Daschbach Discusses Proposed Mandatory ESG Disclosures
Hinshaw partner Bessie Daschbach discussed with the National Law Journal U.S. efforts to establish environmental, social, and corporate governance (ESG) disclosure requirements.
Daschbach noted that moves within the United States toward a regulatory framework for mandatory ESG disclosures trail action taken by the European Union and the United Kingdom. "I do think [movement] is happening at all levels – federal, state, and even in some measure municipal, but then, of course, there is the counter push that has been sort of classified … as the anti-ESG," she said. "It's notable that's not happening elsewhere."
Daschbach added that pressures on businesses to engage in ESG are coming from various markets. "The pressures to manage their risks in response to those markets or to secure opportunities across those markets is the same whether you're in the United States or outside of the United States," she said. "There may be varying temperatures on those pressures, but I think the impulse for companies to engage in ESG is somewhat universal."
