First, is the First Edition of our 50 State Survey: Requirements to Communicate with Insureds for Property and Casualty Claims, authored by the firm's global Insurance Services Practice Group. This book, the Sixth Volume of Hinshaw's On The Law series, provides a 50 state overview for claims professionals of the statutes and regulations that apply in each state to first-party and third-party claims, as they relate to the specific timing of (1) an insurer’s initial response to a notice of claim and to other communications from an insured; and (2) provision of a coverage position or reservation of rights to the insured. Download a copy of the 50 State Survey PDF. You can also download other books in the On The Law series on reinsurance, duty to defend, workers compensation, Medicaid recovery, and COVID-19.
Second, a new commentary "Key U.S. Insurance Decisions, Trends, & Developments: In These Times Of ESG, Social Inflation, COVID-19, Cyber/Privacy, Civil Unrest, Opioids & Other Perils" was published in multiple Mealey’s reports in December and will be published in additional reports in January. Scott Seaman and Sarah Anderson look back at some of the key decisions, trends, and developments impacting the U.S. insurance industry over the past couple of years. They also look ahead to what the new year promises. The authors discuss, that while COVID-19 continues to rage in 2021, ESG/sustainability has taken the spotlight for insurers and reinsurers. They also review developments involving social inflation, COVID-19 business interruption, cyber/privacy, civil unrest, opioids, lead, construction defect, and securities law, among other issues. Third, the Tenth Edition of Scott Seaman’s and Jason Schulze’s treatise Allocation of Losses in Complex Insurance Coverage Claims (Thomson Reuters 10th Ed. 2021-22) will be released shortly by Thomson Reuters. We will issue a separate press release in the coming days. This marks the twenty-first consecutive year in which the treatise has been updated. Key updates were made to the chapters on defense costs and attorney fees, D&O liability insurance, cybersecurity and privacy claims, social inflation, and COVID-19. A new section on ESG/Sustainability was added in this edition along with a new chapter on representations and warranties insurance.
Seaman also mentioned upcoming episodes on Hinshaw Insurance Law Radio and Television scheduled for release in January. Hinshaw Insurance Law will kick off 2022 with special guests Shane Dillon and Shawn Rice, insurance law reporters for Law360. They will discuss key decisions in 2021 and cases to watch in 2022.
Seaman noted that our strategic alliance partner, RPC, puts out an annual global insurance review that touches on all lines of coverage. The 2022 review will be released in January and Hinshaw was pleased to author the U.S. section. Once released, the review will be available on the RPC and Hinshaw websites. Finally, he urged people to be on the lookout for additional insurance and reinsurance law resources that Hinshaw will be putting out in 2022.
