Representative Matters
- After we conducted oral argument and briefing, the Richmond County Supreme Court granted our request for summary judgment on behalf of our client, a national mortgage servicer, in a foreclosure action. The defendants' counterclaim for intentional infliction of emotional distress was dismissed.
- After a computation hearing, the foreclosure referee issued a report that found the full requested amount to be due. Upon moving to confirm the report and for a judgment of foreclosure and sale, the Rockland County Supreme Court approved it without imposing any sanctions on our client, which the court had previously threatened to impose.
- Following briefing and oral argument, the Kings County Supreme Court denied the defendant's motion to dismiss under the statute of limitations and granted summary judgment in favor of our client in a foreclosure action.
- We represented a national mortgage servicer client in a foreclosure action before the Richmond County Supreme Court and settled the matter by convincing the defendants to accept a loan modification. We advised our client on the potential risks involved and encouraged them to take a proactive approach towards reaching a settlement.
- We represented a national mortgage servicer in a foreclosure case before Suffolk County Supreme Court, resulting in a subject property sale.
- The Kings County Supreme Court denied a stay on property sale despite the defendant's order to show cause for a temporary restraining order. We represented a national mortgage servicer in the foreclosure case.
